Yes, under the Foreign Freehold Quota (49% of the building). However, because penthouses are large, they eat up a lot of the foreign quota. If the foreign quota is full, you may need to buy a "Leasehold" penthouse (typically 30+30+30 years). Always check the quota status before placing a deposit.

Marketing terminology. In Phuket, "Sky Villa" usually refers to a penthouse that has a private pool and a large outdoor terrace, mimicking the experience of a villa. A standard "Penthouse" might just be the top floor unit with a balcony. Always check the floor plan for the pool.

Excellent. Phuket is a high-yield tourist market. A sea-view penthouse with a private pool is the highest-demand category for luxury holiday rentals (Airbnb/Booking.com), often commanding 15,000–50,000 THB per night during peak season (Dec-Jan).

Be careful here. Many older low-rise projects (3-4 floors) do not have elevators. You might have to walk up. However, modern luxury projects (like Andamaya or MontAzure) universally include elevators. Always confirm this, especially if purchasing for retirement or accessibility.

The Common Area Fee (CAM Fee) usually covers the maintenance of the common areas, but your private pool is often your responsibility. However, most luxury buildings offer a "Pool Care Package" where the building staff cleans and balances your private pool 2-3 times a week for an extra monthly fee.

Surin & Kamala (Millionaire’s Mile): This is the investment zone. Penthouses here are often branded (e.g., Twinpalms, InterContinental) and managed as 5-star hotel suites. Owners get 30 days of usage and a rental yield return, making it a lifestyle investment.
